Welcome to Advantage Law, a DBA of Higbee & Associates (collectively referred to as the "Firm," "we," "us," or "our").

These Terms of Service ("Terms") govern your access to and use of www.advantage.law and its associated website features, content, communications tools, and services made available through the website (collectively, the "Website").

By accessing or using the Website, you acknowledge and agree to these Terms. If you do not agree, you should discontinue use of the Website.

IMPORTANT NOTICE: These Terms contain provisions concerning dispute resolution, binding arbitration, and a waiver of participation in class actions. Please review Section 14 carefully, as these provisions may affect your legal rights, to the extent enforceable under applicable law.

These Terms govern use of the Website and do not replace, modify, or supersede any separate engagement agreement or other written agreement entered into between you and the Firm. In the event of a conflict concerning legal representation, the applicable engagement agreement will control, subject to applicable law and professional responsibility requirements.

2. General Information and Legal Disclaimer

The information provided on this Website is intended for general informational and educational purposes only and does not constitute legal advice tailored to your individual circumstances.

Although the Firm makes reasonable efforts to provide accurate and current information, laws, regulations, and legal procedures may change and vary by jurisdiction. The Firm makes no representation or warranty that all information on this Website is complete, accurate, current, or applicable to every individual situation.

Visitors should not rely on Website content as a substitute for obtaining advice from a qualified attorney regarding their specific legal circumstances.

3. No Attorney-Client Relationship

Visiting this Website, contacting the Firm, or submitting information through an online form does not, by itself, establish an attorney-client relationship.

An attorney-client relationship is established only when the Firm has agreed to provide legal representation in accordance with its applicable engagement procedures and governing law.

Until representation has been established, visitors should not assume that the Firm is representing them, monitoring legal deadlines, or taking action on their behalf.

Submitting information through the Website may create obligations concerning prospective-client information under applicable law and professional responsibility rules. The Firm handles such information in accordance with its applicable legal and ethical obligations.

4. Attorney Advertising, Licensing, and Jurisdiction

This Website contains attorney advertising. The information presented should not be interpreted as a guarantee of legal representation or any particular legal outcome.

Advantage Law is a DBA of Higbee & Associates. The Firm has attorneys licensed to practice law in jurisdictions throughout the United States.

Legal services offered through Advantage Law are limited to the states and jurisdictions in which those services are available and the Firm is authorized to provide them. Not all services are available in every state.

Testimonials, statistics, client experiences, and reports of past results do not guarantee, warrant, or predict the outcome of any legal matter. Results depend on the unique facts and circumstances of each case.

5. No Credit Repair Services

The Firm does not advertise, offer, or sell credit repair services.

Nothing on this Website should be interpreted as an offer or guarantee to repair credit, improve credit scores, remove accurate information from credit reports, or provide services intended primarily to modify a consumer's credit history.

The Firm provides legal services, which are distinct from credit repair services. Any information concerning the potential effects of legal services on a consumer's credit is provided for general informational purposes and does not constitute a guarantee of any particular credit-related outcome.

6. Equal Opportunity and Nondiscrimination

The Firm is committed to providing its services in a fair and nondiscriminatory manner.

The Firm does not discriminate in the provision of services on the basis of race, color, religion, national origin, sex, age, disability, or any other characteristic protected by applicable law.

Requests for legal representation are evaluated based on relevant factors, including the nature of the legal matter, service availability, attorney licensing requirements, potential conflicts of interest, and the Firm's applicable engagement procedures.

Nothing in this section guarantees acceptance of representation or the availability of any particular legal service.

8. Information Submitted Through the Website

9. Intellectual Property

Unless otherwise indicated, the content available on this Website, including text, graphics, images, logos, videos, designs, software, and other materials, is owned by or licensed to the Firm and is protected by applicable copyright, trademark, and intellectual property laws.

This Website may contain links to third-party websites, resources, platforms, or services.

Such links are provided for convenience and informational purposes. Unless expressly stated otherwise, the Firm does not control, operate, or endorse these third-party websites or their content.

The Firm is not responsible for the accuracy, availability, security, privacy practices, or terms of use of independently operated third-party websites.

Visitors are encouraged to review the applicable terms and privacy policies before providing information to third-party services.

11. Website Availability and Modifications

The Firm reserves the right to modify, update, suspend, or discontinue Website features, content, or functionality at any time, subject to applicable law.

While reasonable efforts are made to maintain Website availability, the Firm does not guarantee that access will be uninterrupted, error-free, or free from technical difficulties.

The Firm is not responsible for interruptions caused by network failures, maintenance, third-party services, or circumstances beyond its reasonable control, except where applicable law provides otherwise.

Changes to Website features or availability do not modify the Firm's obligations under any existing attorney-client engagement agreement.

12. Disclaimer of Warranties

The Website and its content are provided on an "as is" and "as available" basis.

To the fullest extent permitted by applicable law, the Firm disclaims warranties concerning the Website's operation, availability, accuracy, completeness, reliability, security, and suitability for any particular purpose, whether express or implied.

The Firm does not warrant that the Website will be continuously available, free of technical errors, or free from harmful components.

Nothing in this section limits any nonwaivable legal obligations, duties of professional conduct, or rights established by applicable law.

13. Limitation of Liability

To the fullest extent permitted by applicable law, the Firm shall not be liable for indirect, incidental, consequential, special, or exemplary damages arising from the use of or inability to use this Website.

This limitation may include losses resulting from technical interruptions, unauthorized third-party interference, inaccurate third-party information, or other matters relating solely to Website operation.

These limitations do not apply where prohibited by law and are not intended to limit liability arising from attorney malpractice, breaches of professional responsibility, or other obligations that cannot lawfully be waived or restricted.

Any rights and remedies arising from an attorney-client relationship are governed by the applicable engagement agreement, professional responsibility rules, and controlling law.

14. Dispute Resolution, Arbitration, and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING CERTAIN CLAIMS IN COURT OR PARTICIPATE IN CLASS ACTIONS.

Any dispute arising out of or relating to your use of this Website, the services provided through the Website, or your relationship with Advantage Law or Higbee & Associates shall, to the extent permitted by applicable law and subject to any controlling separate agreement, be resolved through confidential, binding arbitration rather than in court.

The Federal Arbitration Act and applicable federal arbitration law shall govern this agreement to arbitrate. Arbitration shall be administered by the American Arbitration Association (AAA) under its applicable rules, including consumer arbitration procedures where appropriate.

Waiver of Court Proceedings and Class Actions

To the extent permitted by applicable law, both you and the Firm acknowledge and agree that:

  • Disputes subject to this arbitration provision will be resolved through binding arbitration rather than court proceedings or other dispute resolution processes.

  • Each party waives the right to a trial by jury for disputes subject to binding arbitration.

  • Either party may bring an action in a court of competent jurisdiction to prevent infringement or other misuse of intellectual property rights.

Arbitration Decisions
